Simline Gift Voucher Terms

These gift voucher terms set out how Simline gift vouchers are purchased and redeemed at simline.eu.

§1 General provisions of the gift voucher terms

  1. These Terms set out the rules for purchasing and redeeming gift vouchers issued by Simline Sp. z o.o. with its registered office in Poznań, Poland, ul. Garbary 100/164, 61-757 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań – Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number 0001197608, NIP (tax ID) 7831938221, REGON 542864867, share capital 5,000 PLN  (the "Issuer"), in the online store at simline.eu (the "Store").
  2. These Terms are terms of service within the meaning of Article 8 of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means and form an integral part of the voucher sale contract. Matters not covered here are governed by the Store Terms available at simline.eu.
  3. Definitions:
    • Voucher — an electronic gift voucher (a PDF document with a unique alphanumeric code and a QR code) entitling its holder to pay for goods in the Store up to the Voucher's Face Value;
    • Buyer — the person who purchases a Voucher in the Store;
    • User — the person who redeems a Voucher, i.e. enters its code in the Store's cart; the User may be the Buyer or a person to whom the Buyer has passed the Voucher;
    • Consumer — a natural person acting for purposes not directly related to their business activity (Article 22¹ of the Polish Civil Code), and a sole trader entitled to consumer protection (Article 7aa of the Polish Consumer Rights Act);
    • Face Value — the amount for which the Voucher was issued, in the currency stated on the Voucher;
    • Validity Period — 12 months from the date of issue, as printed on the Voucher.
  4. Purchasing a Voucher constitutes acceptance of these Terms. The Terms are made available free of charge before an order is placed, in a form that allows them to be downloaded, stored and reproduced (Article 8(1)(2) of the Act on the Provision of Services by Electronic Means).

§2 Nature of the Voucher

  1. The Voucher is a legitimation instrument within the meaning of Article 921¹⁵ of the Polish Civil Code and confirms the right to pay with it for goods in the Store. The Voucher is not a payment card, a payment instrument or electronic money within the meaning of the Polish Act of 19 August 2011 on Payment Services.
  2. Each Voucher is issued to the Buyer's individual order and personalised according to the Buyer's instructions: the Buyer specifies the Face Value, currency, dedication, description, the name of the recipient and the sender. These details are permanently placed on the Voucher document and cannot be changed after issue. A Voucher with such content is not suitable for resale to other customers.
  3. The Voucher is redeemed by whoever enters its code in the Store's cart. The Issuer does not verify the User's identity or whether the User's details match the dedication on the Voucher; the dedication is of a purely commemorative nature.
  4. The Voucher cannot be exchanged for cash, in whole or in part. Any unused part of the Face Value is not paid out in money or in any form other than that set out in §4(9).
  5. Within the meaning of Article 2(44) of the Polish Act of 11 March 2004 on Goods and Services Tax, the Voucher is a multi-purpose voucher: at the time of issue neither the place of supply of the goods nor the applicable tax rate is known, because the Voucher may be redeemed for goods delivered to different countries. The tax consequences of the sale of goods arise when the Voucher is redeemed (Article 8b(1) of that Act).
  6. The Issuer may issue Vouchers in PLN, EUR, USD and GBP. A Voucher is redeemed in the currency in which it was issued; the Issuer does not convert the Face Value into another currency.

§3 Purchasing a Voucher

  1. A Voucher may be purchased only in the Store, by ordering the product "GIFT VOUCHER" and specifying the Face Value, currency and the personalisation details listed in §2(2). The Face Value of a single Voucher ranges from PLN 50 to PLN 15,000. For a Voucher issued in another currency, these limits are the equivalent of those amounts converted at the average exchange rate of the National Bank of Poland published on the business day preceding the day the order is placed.
  2. The Voucher sale contract is concluded when the Issuer confirms acceptance of the order. The Buyer pays for the Voucher an amount equal to its Face Value, in advance only: by payment card, through the payment operator available in the Store, by bank transfer or in cash at the Issuer's registered office. A Voucher cannot be paid for on delivery, in instalments or via PayPal. A Voucher cannot be paid for with another Voucher or a discount code.
  3. The Voucher is issued electronically: once payment is received, the Issuer sends the Voucher document (PDF) to the e-mail address given in the order, no later than within 2 business days. The Buyer may pass the document to the recipient in any way. At the Buyer's request the Issuer may send the Voucher directly to the recipient's e-mail address given in the order.
  4. By placing the order, a Buyer who is a Consumer gives express consent to the Voucher being issued (delivery of personalised digital content) before the withdrawal period expires and acknowledges that, once the Voucher is issued, the right of withdrawal is lost (Article 38(1)(13) of the Polish Consumer Rights Act). Consent is given by ticking a separate box in the cart, and its wording is repeated in the order confirmation (Article 21(1) of that Act).
  5. The Issuer does not issue a VAT invoice or a fiscal receipt for the sale of a multi-purpose Voucher — under Article 8b(1) of the Goods and Services Tax Act the transfer of such a Voucher is not subject to tax. The Buyer receives a purchase confirmation with the order number. A Buyer who is a business receives a debit note for the Face Value; a Consumer receives one on request.
  6. The sales document for goods (fiscal receipt or invoice) is issued only when the Voucher is redeemed, as set out in §4(11).
  7. The Buyer is responsible for the accuracy of the e-mail address and personalisation details given in the order. The Issuer is not liable for non-receipt of the Voucher due to an incorrect address, a full mailbox or spam filters; at the Buyer's request, after verifying the order number, the Issuer resends the Voucher to the address indicated. An obvious typographical error in the personalisation is corrected free of charge at the Buyer's request made before the code is first used; this does not cover a change of the Face Value or currency.
  8. Before issuing a Voucher the Issuer may verify the order for payment security (in particular for high-value orders or several Vouchers in one order) and for that purpose may hold the Voucher for up to 3 business days or refuse to conclude the contract, refunding the amount paid. If the payment for a Voucher is reversed (chargeback, cancelled transfer), the Voucher becomes invalid and orders paid with it may be cancelled.

§4 Redeeming a Voucher

  1. A Voucher may be redeemed only in the Store at simline.eu, within the Validity Period, for goods available in the Store. It cannot be redeemed in physical shops, on the Issuer's other websites or with the Issuer's partners.
  2. Redemption consists in entering the Voucher code in the Store's cart before placing an order. When the order is placed, the Face Value (or part of it) is credited against the price of the goods.
  3. The Voucher covers the price of goods only. It does not cover delivery costs or other charges related to the order (e.g. shipment insurance, cash-on-delivery fee); the User pays these separately using the payment methods available in the Store.
  4. The price of goods covered by the Voucher includes value added tax (VAT) due on delivery within Poland and other Member States of the European Union, charged at the rate applicable in the country of delivery.
  5. For delivery outside the European Union the price of goods in the Store does not include VAT. The Voucher does not cover customs duties, import tax, VAT or other charges and public levies imposed in the country of receipt; these are borne by the recipient of the shipment and collected by the carrier or customs authority on receipt, regardless of payment with a Voucher. The Issuer does not know the amount of these charges at the time of sale.
  6. A Voucher may be redeemed for orders delivered to the countries to which the Store ships; the current list of countries and delivery methods is available in the Store before the Voucher is purchased and before it is redeemed. The unavailability of delivery to a given country or of a particular delivery method is not a defect of the Voucher and does not entitle the Buyer to withdraw from the Voucher sale contract or to a refund of its price. The User may indicate a delivery address in another country served by the Store.
  7. The Voucher does not guarantee the availability of any particular product or that its price will be maintained. Goods are sold at the prices in force in the Store at the time the Voucher is redeemed; a price reduction after redemption does not entitle the User to a refund of the difference. The Issuer may change the Store's range during the Validity Period.
  8. If the order value exceeds the Face Value, the User pays the difference using the payment methods available in the Store.
  9. If the order value is lower than the Face Value, the unused part remains on the Voucher and may be used for further orders within the Validity Period of the same Voucher. The Issuer does not give change in cash or transfer the unused part to a bank account. The current balance of a Voucher is visible only in the Store's cart after entering the code, when attempting to redeem it.
  10. Only one Voucher may be used per order. A Voucher may be combined with promotions and discount codes in force in the Store unless the terms of a given promotion provide otherwise. A Voucher cannot be used to pay for another Voucher.
  11. The sale of goods paid for with a Voucher is settled with the User. The Issuer issues a fiscal receipt or — on request made when placing the order — an invoice in the User's details given in the order (Articles 106b and 111 of the Goods and Services Tax Act). The Issuer does not issue a sales document for goods in the name of the Buyer of the Voucher if the Buyer is not the User.
  12. A User who redeems a Voucher purchases goods under the Store Terms and enjoys all the rights of a buyer, including those arising from the statutory warranty and from non-conformity of goods with the contract (Chapter 5a of the Polish Consumer Rights Act).
  13. The Issuer may refuse to redeem a Voucher if: the Validity Period has expired; the code has already been fully used; the Voucher has been reported lost under §8; the Voucher has become invalid under §3(8); there is reasonable suspicion that the Voucher was obtained by fraud.
  14. If, during the last 3 days of the Validity Period, the Store was unavailable for reasons attributable to the Issuer for a total of at least 12 hours, the Issuer extends the Validity Period by 7 days at the User's request made within 14 days of the end of the Validity Period.

§5 Validity period

  1. A Voucher is valid for 12 months from the date of issue. The expiry date is printed on the Voucher ("Valid until") and stated in the purchase confirmation. The Validity Period is not extended, except in the cases described in §4(14) and §7(6).
  2. The Voucher must be redeemed no later than on the last day of the Validity Period, by placing an order using the Voucher code. An order paid with a Voucher and subsequently cancelled through the User's fault (e.g. failure to collect the shipment) does not restore the Voucher if the Validity Period has meanwhile expired.
  3. On expiry of the Validity Period the Voucher lapses and any unused Face Value is forfeited. Neither the Buyer nor the User may demand its refund in money or the issue of a new Voucher. The amount paid for the Voucher is the Issuer's remuneration for issuing the Voucher and remaining ready to redeem it throughout the Validity Period.
  4. After the Voucher expires, the Issuer sends the Buyer, to the e-mail address given at purchase, a notice of expiry with the order number and the unused value. The expiry of a multi-purpose Voucher is neither a supply of goods nor a supply of services, so the Issuer does not issue a fiscal receipt or a VAT invoice in respect of it.
  5. Keeping track of the Voucher's expiry date is the responsibility of the Buyer and the User. The Issuer does not send reminders about the approaching end of the Validity Period.

§6 Right of withdrawal from the Voucher sale contract

  1. As a rule, a Consumer has the right to withdraw from a distance contract within 14 days without giving any reason (Article 27 of the Polish Act of 30 May 2014 on Consumer Rights).
  2. This right does not apply to the Voucher, because the Voucher is personalised digital content not supplied on a tangible medium, and the Issuer delivers it before the withdrawal period expires with the Consumer's express prior consent, the Consumer having been informed of the loss of the right of withdrawal, having acknowledged it and having received confirmation of the contract (Article 38(1)(13) of the Consumer Rights Act). Consent is obtained as described in §3(4).
  3. Independently of paragraph 2, the Voucher is issued to the Buyer's individual specification — with its Face Value, currency, dedication, description, recipient and sender — and serves the Buyer's individualised needs. Such a Voucher cannot be put back on sale, which corresponds to the nature of the supplies referred to in Article 38(1)(3) of that Act.
  4. If the Consumer does not give the consent referred to in §3(4), the Issuer will issue the Voucher only after 14 days from the conclusion of the contract, and until then the Consumer may withdraw from the contract on general terms by sending a statement to the address given in §9. The Issuer then refunds the full amount paid within 14 days, using the same payment method (Article 32 of the Consumer Rights Act).
  5. In no case does the right of withdrawal apply after the Voucher code has been used, even in part.
  6. Paragraphs 2–5 do not limit the Consumer's rights arising from the Voucher's non-conformity with the contract (e.g. a defective code, an incorrect Face Value) — such cases are handled as complaints under §9 and Chapter 5b of the Consumer Rights Act.

§7 Returning goods bought with a Voucher

  1. Goods purchased with a Voucher are subject to the withdrawal and complaint rules set out in the Store Terms and in the Consumer Rights Act. Using a Voucher neither limits those rights nor extends them beyond the Store Terms.
  2. Returned goods should be complete, in unchanged condition and fit for resale, in accordance with the Store Terms. The Consumer is liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning (Article 34(4) of the Consumer Rights Act). The amount refunded to the Voucher is reduced by the diminished value so determined.
  3. Establishing the nature, characteristics and functioning of goods means examining them in the way that would be possible in a physical shop: removing them from the packaging, looking at them, checking that the set is complete and matches the description. The following in particular go beyond that scope: mounting the goods on a rig or in a cockpit, connecting them to a computer and activating software, using them in gameplay or training, removing protective films and seals from functional parts, destroying or discarding the packaging and transport protection. The Issuer determines the amount of the diminished value individually and gives reasons in its response to the return.
  4. In the event of withdrawal from the contract of sale of goods, or acceptance of a complaint with a refund of the price, the Issuer refunds the amount paid with the Voucher by restoring it to the same Voucher, and any amount paid by another method — using the same payment method the User used (Article 32(2) of the Consumer Rights Act). The part paid with the Voucher is not refunded in cash or by bank transfer.
  5. Restoring an amount to the Voucher does not extend its Validity Period. The restored amount may be used only until the end of the original Validity Period stated on the Voucher.
  6. If an amount is restored to a Voucher after its Validity Period has expired, the Issuer — as a goodwill gesture, without any obligation under these Terms — grants an additional 30 days from the date of restoration to use that amount. Such an extension is granted only once per Voucher; any amount not used within that period is forfeited under §5(3).
  7. Returning goods does not entitle the Buyer of the Voucher to a refund of the Voucher price if the Buyer is not the User.

§8 Loss and unauthorised use of a Voucher

  1. The Voucher code entitles any person who enters it to redeem the Voucher. The Buyer and the User must protect the Voucher document and code from access by third parties; the Issuer is not liable for redemption by an unauthorised person if it took place before the report referred to in paragraph 2.
  2. Loss, theft or unauthorised disclosure of the code may be reported to the address given in §9, quoting the Voucher's order number. After the report the Issuer blocks the code and — if the Voucher has not yet been redeemed — issues the Buyer a new Voucher for the unused value with the original Validity Period.
  3. The Issuer does not issue a duplicate of a Voucher redeemed before the report. Information about a Voucher (status, balance, the Buyer's details, redemption history) is disclosed only to the Buyer, after verification of the order number. It is not disclosed to the recipient or to any other person — the Issuer has no data that would allow it to verify whether a given person is the recipient named on the Voucher.
  4. The Issuer may block a Voucher obtained by fraud, payment chargeback or a breach of the Store Terms, notifying the Buyer at the e-mail address from the order.

§9 Complaints and disputes

  1. Complaints concerning a Voucher (e.g. non-receipt, incorrect details on the Voucher, a code that does not work) may be submitted in writing to the Issuer's registered office or by e-mail to info@simline.eu, quoting the order number, the Voucher code and a description of the problem.
  2. The Issuer responds to a Consumer's complaint within 14 days of receipt (Article 7a of the Consumer Rights Act). Failure to respond within that time means the complaint has been accepted.
  3. A Consumer may use out-of-court complaint and redress procedures under the Polish Act of 23 September 2016 on Out-of-Court Resolution of Consumer Disputes, in particular by applying to the Provincial Inspector of Trade Inspection in Poznań for mediation or for the dispute to be resolved by a permanent arbitration court, or by seeking free assistance from a municipal or district consumer ombudsman or a consumer organisation (e.g. Federacja Konsumentów). Consumers from other EU Member States may contact the European Consumer Centre in their country.
  4. The Issuer does not take part in out-of-court dispute resolution before any other body unless required by law or unless it agrees to do so in a particular case.
  5. Disputes with Consumers are resolved by the court having jurisdiction under general rules. Disputes with Buyers and Users who are not Consumers are resolved by the court having jurisdiction over the Issuer's registered office.

§10 Personal data

  1. The controller of the personal data of the Buyer and the User is the Issuer. Data are processed to conclude and perform the contract of sale of the Voucher and of goods (Article 6(1)(b) GDPR), to fulfil tax and accounting obligations (Article 6(1)(c) GDPR) and to establish and pursue claims (Article 6(1)(f) GDPR).
  2. The Buyer provides the recipient's details (name, dedication and e-mail address, if given) on the Buyer's own responsibility and declares that the Buyer is entitled to pass them to the Issuer for this purpose.
  3. Data are stored for the Voucher's Validity Period and thereafter for the period required by tax law and until the limitation periods for claims expire.
  4. Full information on data processing, including the rights of data subjects (Article 13 GDPR), is available in the Privacy Policy at: https://simline.eu/en/content/privacy-policy.

§11 Final provisions

  1. These Terms apply from 16 October 2026 to Vouchers purchased on or after that date.
  2. The Issuer may amend these Terms for important reasons, in particular a change in the law, in the way Vouchers are issued or redeemed, or in the Store's range. Amendments do not apply to Vouchers purchased before they take effect — such Vouchers are governed by the Terms in force on the date of purchase, available in the terms archive at simline.eu.
  3. Matters not covered here are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on the Provision of Services by Electronic Means. The choice of Polish law does not deprive a Consumer from another Member State of the European Union of the protection afforded by the mandatory provisions of the law of that Consumer's country (Article 6(2) of the Rome I Regulation).
  4. Nothing in these Terms excludes or limits the rights of Consumers under mandatory provisions of law. If any provision is found to be unfair (Article 385¹ of the Polish Civil Code), the remaining provisions remain in force.
  5. These Terms are available at simline.eu in a form that allows them to be downloaded and saved (PDF). In the event of any discrepancy between the Polish and English versions, the Polish version prevails.
